1. Agreement
These Terms of Service ("Terms") govern access to and use of Orbi, its website, and related services (together, the "Services") provided by OBRIY STUDIO ("we", "us", or "our"). By installing or using the Game, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services.
If you are below the age of legal majority where you live, a parent or legal guardian should review and accept these Terms for you.
2. Limited License
We grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use Orbi for lawful, non-commercial entertainment. We retain all rights not expressly granted.
3. Acceptable Use
You may not:
- copy, sell, rent, sublicense, redistribute, or commercially exploit the Game except where law expressly permits;
- reverse engineer, modify, or create derivative versions except to the limited extent that applicable law cannot prohibit it;
- use cheats, automation, unauthorized modifications, exploits, or tools intended to manipulate progression, rewards, rankings, or Game operation;
- bypass security, update, access, or platform controls;
- introduce malicious code, interfere with the Services, or infringe the rights of others;
- misrepresent an association with OBRIY STUDIO or use Orbi assets in a misleading or unlawful way.
4. Local Progress
The current release has no Orbi account or cloud save. Profile information, progress, settings, and virtual balances are stored locally. They may be lost if the Game is uninstalled, app storage is cleared, a device fails, or an operating-system backup is unavailable or incompatible.
We do not guarantee recovery, transfer, or preservation of local progress.
5. Virtual Items And Rewards
Gold, crystals, rewards, ranks, upgrades, unlocks, and other virtual items are licensed features of the Game. They have no cash value, are not legal tender or property, and cannot be sold, transferred, or exchanged for real money unless the Game expressly provides a lawful mechanism.
We may balance, modify, limit, or remove virtual items or progression systems when reasonably needed for gameplay, security, technical, or legal reasons.
6. Advertising
Version 1.0.0 does not contain active advertising. If a future release offers advertising, it may include optional rewarded ads or interstitial placements. Availability, frequency, and the reward offered may change. A reward is granted only after the advertising provider confirms successful completion where confirmation is technically required.
Advertising will be subject to the updated Privacy Policy, consent choices required by law, and the terms of the relevant provider. We are not responsible for the content, products, or websites of third-party advertisers.
7. Digital Purchases
Version 1.0.0 does not offer active real-money purchases. If purchases are offered later, they will provide a limited license to use the relevant digital content in the Game. Purchases will be processed by the applicable store platform and are also subject to its payment, cancellation, and refund rules.
Prices, taxes, availability, and included content will be shown before purchase. Except where required by law or platform policy, digital items are not redeemable for cash and are not transferable. Contact the store operator for billing issues and support@obriystudio.app for delivery issues.
8. Ownership
Orbi, its code, original art, characters, design, text, music, sound, and branding are owned by OBRIY STUDIO or its licensors. Third-party materials remain owned by their respective licensors and are used under applicable licenses. No ownership rights are transferred to you.
9. Third-Party Platforms And Links
The Services may rely on or link to Google Play, Firebase, GitHub Pages, or other third-party services. Their own terms and privacy policies apply to their services. We do not control third-party availability, content, or independent processing.
10. Updates And Availability
We may update, rebalance, change, suspend, or discontinue any part of the Services. An update may be required for compatibility, security, legal compliance, or continued use. We do not promise that every device, operating-system version, or feature will remain supported indefinitely.
11. Suspension And Termination
You may stop using the Services at any time by uninstalling the Game. We may restrict or terminate the license if you materially violate these Terms, threaten the security or operation of the Services, or use the Game unlawfully. Sections that by their nature should survive termination will remain effective.
12. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available". We do not warrant uninterrupted or error-free operation, compatibility with every device, preservation of local progress, or fitness for a particular purpose. Mandatory consumer rights remain unaffected.
13. Limitation Of Liability
To the maximum extent permitted by law, OBRIY STUDIO is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost local progress, virtual items, data, opportunity, or profit arising from the Services. This limitation does not exclude liability that cannot legally be limited, including applicable liability for fraud, willful misconduct, or personal injury.
14. Changes To These Terms
We may update these Terms for product, legal, security, or technical changes. The current version and effective date will be posted here. Where required, material changes will be communicated through the Game or another reasonable channel. Continued use after an effective update means acceptance where permitted by law.
15. General Terms
If a provision is unenforceable, the remaining provisions stay effective. A failure to enforce a provision is not a waiver. These Terms do not limit mandatory rights available under the laws of your country of residence.
